1. It is incompatible with the principle of equality before the law in Arti- cle 3.1 of the Basic Law (Grundgesetz) that the amount of the basic disability pension granted to war victims under § 31.1 sentence 1 of the Federal War Victims Relief Act (Bundesversorgungsgesetz) in the areas of the former Federal Republic of Germany and German Democ- ratic Republic varies beyond 31 December 1998 where the disability is the same.
2. § 84a of the Federal War Victims Relief Act is therefore void from 1 January 1999.
