Judge of the Constitutional Court of Ukraine Stanislav Shevchuk attended the official ceremony of the celebration of the 20th anniversary of entering into force of the European Convention on Human Rights in respect of the Republic of Moldova
On October 6, 2017 Judge of the Constitutional Court of Ukraine Stanislav Shevchuk attended the official ceremony of the celebration of the 20th anniversary of entering into force of the 1950 Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights) in respect of the Republic of Moldova.
The event was attended by the President of the Constitutional Court of Moldova Tudor Panțîru, acting and former judges of this court, the President of the European Court of Human Rights Guido Raimondi, the President of the Constitutional Court of the Republic of Lithuania Dainius Žalimas, the Vice-President of the Constitutional Court of Georgia Teimuraz Tughushi, the Speaker of the Parliament of the Republic of Moldova Andrian Candu and other government senior officials.
In his opening speech, the President of the Constitutional Court of the Republic of Moldova Tudor Panțîru emphasised the importance of joining Moldova to the Convention, which brought significant benefits to the state. In his view, European case law includes official interpretation of the Convention and is binding for Moldovan public and judicial authorities.
The Speaker of the Parliament of the Republic of Moldova Andrian Candu thanked the President of the European Court of Human Rights for his participation in such an important event for Moldova. He emphasised that in the context of observance of the Convention by Moldova, the parliament takes into account "the possibility of applying the mechanism of parliamentary control to strengthen monitoring of the implementation of the Court's judgments".
According to the Minister of Justice of the Republic of Moldova Vladimir Cebotari, the implementation of the Convention has shown that the national authorities consider it as a catalogue of imperative values, which rarely allows for derogations. In addition, due to the implementation of the Convention in Moldova new institutions (the Council for the Prevention and Elimination of Discrimination and Equality) have been established, while existing ones have been improved (the Ombudsman's Institute).
The President of the European Court of Human Rights Guido Raimondi was a guest of honour of the event. He noted that the proceedings related to human rights had increased to 70% among all cases decided by the Constitutional Court of the Republic of Moldova. This fact makes it possible to call the Constitutional Court of the Republic of Moldova a "genuine human rights tribunal".
The President of the European Court of Human Rights pointed out the Judgment of the Constitutional Court of the Republic of Moldova No. 2/2016 on exceptional cases of unconstitutionality, which allowed the Court to examine more than 150 exceptions in the first year after the decision had been passed. In addition, the European judge referred to the similarity between the content of certain judgments of the European Court of Human Rights and the Constitutional Court of the Republic of Moldova.
Guido Raimondi is convinced that the election of Tudor Panțîru, who was the first judge of the European Court of Human Rights in respect of the Republic of Moldova, as the President of the Constitutional Court of the Republic of Moldova, will help ensure the practical application of the experience gained by the Strasbourg court in this state.
The event was held at the Palace of the Republic, in Chișinău. The ceremony gathered about 250 invitees, including representatives of the judiciary, scholars, members of the Association of Constitutional Justice of the Countries of the Baltic and Black Sea Regions (BBCJ), and others.
