The CCU considered the case on the constitutionality of the law on state financial guarantees of medical care

 

On July 23, the Grand Chamber of the Constitutional Court of Ukraine continued consideration of the case upon the constitutional petition of 59 People's Deputies of Ukraine on the constitutionality of the Law of Ukraine "On State Financial Guarantees of Medical Care" of October 19, 2017 № 2168-VIII (hereinafter - the Law).

Judge-rapporteur in the case Serhiy Holovaty noted that the subject of the right to a constitutional petition requests the Constitutional Court of Ukraine to examine the Law for compliance with Articles 8, 19, 22, 26, 49, 64, 85, 92, 95 of the Constitution of Ukraine.

He also said that in order to ensure a full and objective consideration of the case, inquiries were sent to public authorities, research institutions and higher education institutions, namely: the Ministry of Healthcare of Ukraine, the National Health Service of Ukraine, National University "Kyiv-Mohyla Academy", Vasyl Stus Donetsk National University, Ivan Franko Lviv National University, Ilya Mechnikov Odesa National University, Research Institute of Comparative Public Law and International Law of Uzhhorod National University, Yaroslav Mudryi National Law University, Volodymyr Koretsky Institute of State and Law of the National Academy of Sciences of Ukraine, Platon Shupyk National Medical Academy of Postgraduate Education, Lev Hromashevskyi Institute of Epidemiology and Infectious Diseases of the National Academy of Medical Sciences of Ukraine, Vasyl Komisarenko Institute of Endocrinology and Metabolism of the National Academy of Medical Sciences of Ukraine, Oleksandr Marzeyev Institute of Public Health of the National Academy of Medical Sciences of Ukraine, Oleksandr Palladin Institute of Biochemistry of the National Academy of Sciences of Ukraine,  Oleksandr Shalimov National Institute of Surgery and Transplantology of the National Academy of Medical Sciences of Ukraine, Feofil Yanovskyi National Institute of Tuberculosis and Pulmonology of the National Academy of Medical Sciences of Ukraine, as well as to individual scientists.

During the plenary session, the Court heard the positions of the participants in the constitutional proceedings on the subject of constitutional review, in particular - representatives of the subject of a right to constitutional petition Ihor Shurma and Vasyl Nimchenko, Permanent Representative of the Verkhovna Rada of Ukraine to the Constitutional Court of Ukraine Olha Sovhyria and Representative of the President of Ukraine to the Constitutional Court of Ukraine Fedir Venislavskyi.

The participants of the constitutional proceedings - Deputy Minister of Healthcare - Chief State Sanitary Doctor of Ukraine Viktor Liashko, Acting Head of the National Health Service of Ukraine Oksana Movchan, Director of the Legal Department of the National Health Service of Ukraine Iryna Zhyhinas, Vice-President of the National Academy of Medical Sciences of Ukraine, Academician Volodymyr Kovalenko, as well as Vice-rector for Research and Educational work of Platon Shupyk National Medical Academy of Postgraduate Education, Doctor of medical sciences, Professor Oleksandr Tolstanov, Head of the Department of Infectious Diseases of the Oleksandr Bohomolets National Medical University, Doctor of Medical Sciences, Professor Olha Holubovska, Associate Professor of the Institute of Law of Taras Shevchenko National University of Kyiv, Director of the Research Institute of Medical and Pharmaceutical Law and Bioethics of the Academy of Advocacy of Ukraine, Candidate of Law Radmyla Hrevtsova, Head of the Department of Medical Law of the Faculty of Postgraduate Education of Danylo Halytskyi Lviv National Medical University, Doctor of Law, Associate Professor Iryna Seniuta also presented their positions.

The Chairman of the Constitutional Court of Ukraine Oleksandr Tupytskyi chaired the plenary session.

The Court completed its examination of the case file in the public part of the plenary session and proceeded to the in-camera part for a decision.

The plenary session was also attended by representatives of the media and the public.
