October 26. The Court Agenda (Approved). The Grand Chamber of the Court deliberated cases upon constitutional petitions. The Boards of Judges adopted rulings

Today, October 26, plenary sessions of the Grand Chamber of the Court, during which cases upon constitutional petitions were deliberated, and sessions of the First Board of Judges of the First Senate and the Second Board of Judges of the Second Senate of the Court were held.

The Grand Chamber of the Court proceeded with deliberation of the following cases:

• upon the constitutional petition of 50 People's Deputies of Ukraine on compliance of the Law of Ukraine “On Amendments to Article 80 of the Constitution of Ukraine (on the Inviolability of People's Deputies of Ukraine)” with the Constitution of Ukraine (constitutionality);

• upon the constitutional petition of the Verkhovna Rada of Ukraine Commissioner for Human Rights on the constitutionality of parts five, sixteen of Article 16 of the Fundamentals of the Legislation of Ukraine on Health Care, Article 4.6 of the Law of Ukraine “On State Financial Guarantees of Medical Care of the Population”, Article 29.4 of the Law of Ukraine “On Protection of the Population from Infectious Diseases”, paragraph two of section II of the Law of Ukraine “On Amendments and Repeal of Certain Legislative Acts of Ukraine” with the Constitution of Ukraine (constitutionality);

• upon the constitutional petition of 46 People's Deputies of Ukraine regarding the official interpretation of the provisions of the first sentence of Article 13.1, Article 14.1 of the Constitution of Ukraine;

• upon the constitutional petitions of the Supreme Court of Ukraine concerning the compliance of the provisions of clause 6 of paragraph one, clauses 2, 13 of paragraph two, paragraph three of Article 3 of the Law of Ukraine “On Purification of Power” of September 16, 2014 No. 1682-VII with the Constitution of Ukraine, 47 People's Deputies of Ukraine concerning the compliance of the provisions of paragraphs three, six of Article 1, paragraphs one, two, three, four, eight of Article 3, clause 2 of paragraph five of Article 5, paragraph 2 of the Final and Transitional Provisions of this Law with the Constitution of Ukraine, the Supreme Court of Ukraine concerning the compliance of the provisions of paragraph three of Article 1, clauses 7, 8, 9 of paragraphs one, clause 4 of paragraph two of Article 3, paragraph 2 of the Final and Transitional Provisions of this Law with the Constitution of Ukraine and the Supreme Court of Ukraine concerning the compliance of the provisions of paragraph 3 of Article 4 of this Law with the Constitution of Ukraine.

The Court will proceed with deliberation of these cases at one of the next plenary sessions.

On the same day, the Boards of Judges of the Court considered the initiating of constitutional proceedings in the following cases:

 -  of Ivan Fedorchenko concerning the official interpretation of the provisions of Article 64.1, Article 157.1 of the Constitution of Ukraine in conjunction with the provisions of paragraph 14 of Section I of the Law of Ukraine “On Amendments to the Constitution of Ukraine (with respect to Justice)” No. 1401–VIII, Article 150.2 of the Constitution of Ukraine; 

- upon the constitutional complaint of Denys Karlashevych on the compliance of Article 27.1 of the Law of Ukraine “On Pledge” with the Constitution of Ukraine;

 - upon the constitutional complaint of Oleksiy Pukach regarding the compliance of the provisions of paragraph 15 of Section XI “Transitional Provisions” of the Criminal Procedure Code of Ukraine with the Constitution of Ukraine.

Based on the results of the deliberation, the rulings (final) of the Boards of Judges on the refusal to initiate constitutional proceedings in these cases were adopted.
