Tuesday, 21 December, the Grand Chamber, at the in-camera part of the plenary session, considered the case upon the constitutional petition of 47 People’s Deputies of Ukraine on conformity of specific provisions of Article 6 of the Law of Ukraine “On Television and Radiobroadcasting“, Articles 15, 15-1 and 26 of the Law of Ukraine “On Cinematography“ to the Constitution of Ukraine. Upon the results of consideration of the case, the Decision No. 3-r/2021 was adopted, which will be promulgated at the Court’s official website.
The Grand Chamber, at the plenary session, considered the case upon the constitutional petition of the Ukrainian Parliament Commissioner for Human Rights on conformity of the provisions of Articles 16.5 and 16.16 of the Fundamentals of the Legislation on Health Protection, Article 29.4 of the Law of Ukraine “On Protection of Population Against Infectious Diseases“, paragraph two of Section II of the Law of Ukraine “On Amending and Declaring as Such that Lost Their Effect of Some Legislative Acts of Ukraine” to the Constitution of Ukraine. Further deliberation of the case will take place at a forthcoming plenary sessions.
At the Grand Chamber’s sitting, 12 rulings were adopted on extending until 20 January 2022 of a term for the boards of judges to rule on initiating or refusal to initiate constitutional proceedings in the cases upon the constitutional complaints of O.Ananchenko, I.Rizdvanetska, O.Abramovych, V.Sydorenko, V.Solovichenko, O.Bobyr, O.Losiev, O.Soshka, V.Vitenko, S.Kalamber, A.Yefimenko, M.Andrieiev.
The same day, a session of the Second Board of Judges of the Second Senate was held. The judges adopted a ruling (final) to refuse to initiate constitutional proceedings in the case in the case upon the constitutional complaint of K.Duzenko on conformity of the provisions of Articles 290.2, 290.3.1, 290.12 of the Code of Criminal Procedure of Ukraine to the Constitution of Ukraine.
