On October 25, the fourth meeting of the Research Advisory Council of the Constitutional Court of Ukraine (hereinafter referred to as the Council) took place. Judges of the Constitutional Court, retired judges of the Court, members of the Council, and employees of the Court’s Secretariat attended the meeting.
The Chairman of the Standing Commission on Scientific Support of the Constitutional Court of Ukraine, judge Viktor Kolisnyk, addressed the participants with a welcoming remarks.
He noted that Ukraine is currently in a very difficult stage of state formation and is once again forced to fight for its right to exist, independence, and state sovereignty. In such circumstances, the role of all state authorities is crucial, as the latter must demonstrate that Ukraine functions properly as a State. Therefore, according to him, the role of the Council is constantly growing, as its activity should contribute to improving the quality and validity of decisions and conclusions of the Constitutional Court of Ukraine. The judge warned that today, when the country is at war, information should be treated with caution, both officials and journalists should practice self-censorship, as well as scientists and Council members should thoroughly discuss these issues and make recommendations to determine where the limit of information dissemination is. Viktor Kolisnyk expressed his profound gratitude to the Council members for the scientific conclusions they provided, and expressed hope for further fruitful cooperation.
In his report, judge Viktor Kolisnyk focused on the organisational issues of the Council, as well as the forms and formats of cooperation between its members and judges of the Court in the process of preparing scientific conclusions.
The judge of the Constitutional Court of Ukraine, Oksana Hryshchuk, presented a report on the topic “Constitutional values and principles in the decisions of the Constitutional Court of Ukraine: peculiarities in the conditions of martial law”.
The judge discussed the work of Constitutional Court of Ukraine under martial law, noting that the Court responds to these challenges and continues its activities.
Oksana Hryshchuk emphasized the concept of “democracy capable of defending itself”, noting that democracy is based on compromise, which necessitates certain concessions in order to ensure the overall stability of a state. The judge specifically mentioned some decisions of the Constitutional Court of Ukraine that were delivered to protect the State’s democratic constitutional order.
Judges of the Constitutional Court of Ukraine Olha Sovhyria and Oleksandr Petryshyn spoke at the meeting about expanding forms of cooperation between the Council members and judges of the Constitutional Court of Ukraine.
Serhii Riznyk, Deputy Head of the Council and Vice-Rector for Scientific and Pedagogical Work and International Cooperation at Ivan Franko Lviv National University, also delivered a report on the mentioned topic.
The First Deputy Head of the Secretariat of the Court, Larysa Biriuk, spoke about monitoring the implementation of the Court’s decisions and identifying markers that should testify to their implementation.
The meeting was chaired by the Head of the Council, the Vice-Rector for Research and Academic Affairs and Strategic Development of the Yaroslav the Wise National University of Law Yurii Barabash.
Its participants with an interactive discussion continued the Council meeting. During this part of meeting judges of the Constitutional Court of Ukraine Oleh Pervomaiskyi and Galyna Yurovska, retired judge of the Constitutional Court of Ukraine Mykhailo Kostytskyi, and Council members Oksana Shcherbaniuk and Anzhelika Krusian made their scientific reports.
