On Wednesday, January 25, the sessions of the First Senate of the Court and the First, Second and Third Boards of Judges of this Senate were held.
At the in-camera part of the plenary session the First Senate proceeded with deliberation of the case upon the constitutional complaint of Ihor Stefurak regarding the constitutionality of the provision of Article 87.3.1.2 of the Law of Ukraine “On Public Service” dated December 10, 2015 No. 889-VIII, as amended by the Law of Ukraine “On Amending the Customs Code of Ukraine and Some Other Legislative Acts of Ukraine in view of the Implementation of Administrative Reform” dated January 14, 2020 No. 440-IX. The Court will proceed with its deliberation at one of the next plenary sessions.
In the case upon the constitutional complaint of Andrii Franko regarding the compliance of the provisions of Article 483.1.2 of the Customs Code of Ukraine with the Constitution of Ukraine, the First Senate adopted a Ruling on deliberation of this case in the form of written proceedings.
On the same day, the Board of Judges deliberated the issue of initiating constitutional proceedings in the following cases:
· upon the constitutional complaint of Ruslan Shapoval regarding the constitutionality of Article 183.3 of the Family Code of Ukraine;
· upon the constitutional complaint of Maksym Omelchenko regarding the constitutionality of the provisions of Article 71.2 of the Law of Ukraine “On Executive Proceedings” dated June 2, 2016 No. 1404-VIII;
· upon the constitutional complaint of Mykola Bryhynets regarding the constitutionality of certain provisions of subparagraphs 3, 4 of paragraph 1, paragraph 2 of Section I of Law of Ukraine “On Amending Certain Legislative Acts of Ukraine on Housing Provision of Citizens”;
· upon the constitutional complaint of Hanna Krytsak regarding the constitutionality of Article 19.6.1, Article 19.6.5, Article 389.3.2 of the Civil Procedure Code of Ukraine.
Upon the results of the deliberation, the Board of Judges adopted 4 Rulings (final) on the refusal to initiate constitutional proceedings in these cases.
