Judge of the Constitutional Court of Ukraine Vasyl Lemak: “The legal culture of politicians, its level, is the main factor that determines the solution of the problem of pressure on the court and judges”

On June 15, 2024, Judge of the Constitutional Court of Ukraine Vasyl Lemak participated in the meeting of the Legal Aspect Discussion Club on the topic “Pressure on the court: How to protect judicial independence?”

In his speech, Vasyl Lemak pointed out that if a state has an independent court, it is successful.

Vasyl Lemak noted that the provisions of the Constitution of Ukraine regarding the independence of judges, which is an integral element of the status of judges and their professional activities, are related to the principle of separation of state power and are conditioned by the need to guarantee the autonomy and independence of the judiciary.

The CCU judge emphasised that the political elite must understand that it must be restrained by someone. The legal culture of politicians, its level, is the main factor on which the problem of pressure on the court and judges depends. This level, in turn, depends on institutional mechanisms, not just on evolution over time.
