October 27. The Court Agenda (approved). The Second Senate deliberated the case upon the constitutional complaint of O. Abramovich. The Board of Judges adopted 2 rulings

On Wednesday, October 27, the Second Senate of the Court at in-camera part of the plenary session proceeded with deliberation of the case upon the constitutional complaint of Oleksii Abramovich regarding the constitutionality of Article 40.2.2 of the Housing Code of the Ukrainian SSR.

Its deliberation will be proceeded at one of the next plenary sessions of the Second Senate.

On the same day, the First Board of Judges of the Second Senate of the Constitutional Court of Ukraine held its session to consider initiating constitutional proceedings in the case upon the constitutional complaint of Larysa Bobyr on the constitutionality of specific provisions of Article 58.6 of the Law of Ukraine “On Banks and Banking”.

Based on the results of its deliberation, the Ruling of the Board of Judges on the refusal to initiate constitutional proceedings upon the constitutional complaint (not unanimous) was adopted. Therefore, the issue of initiating constitutional proceedings in this case will be deliberated at the session of the Second Senate of the Court.

In addition, the First Board of Judges of the Second Senate deliberated the issue of initiating constitutional proceedings in the case upon the constitutional complaint of JUSSO UKRAINE Limited Liability Company on the compliance of the provisions of parts one and three of Article 255 of the Commercial Procedural Code of Ukraine of November 6, 1991 1798 – XII with the Constitution of Ukraine. As a result of the deliberation, the Ruling on the refusal to initiate constitutional proceedings (final) was adopted.
