Today, on March 14, the Grand Chamber at the plenary session adopted the Ruling on the consolidation of cases into one constitutional proceedings upon the constitutional complaints of Anatolii Dushenkevych, Iryna Yarosh, and Andrii Franko regarding the constitutionality of Article 483.1.2 of the Customs Code of Ukraine. The case will be deliberated by the Second Senate.
Also at the session, the Grand Chamber adopted 3 rulings on the extension until April 13, 2023 the deadline for the adoption by the boards of judges of rulings on initiating or refusing to initiate constitutional proceedings in cases upon constitutional complaints of V. Produn, Ye. Yevhrafova, and O. Bredun.
On the same day, sessions of the boards of judges of the First and Second Senates took place, at which the judges deliberated the issue of initiating constitutional proceedings in cases.
As a result of their deliberation, the First Board of Judges of the First Senate adopted a Ruling (final) on refusing to initiate constitutional proceedings in the case upon the constitutional complaint of Oleksandr Kuzmenko regarding the constitutionality of the provisions of Article 19.9 of the Civil Procedure Code of Ukraine in substantive conjunction with Article 389.3.2.1 of this Code, and adopted a Ruling on initiating constitutional proceedings in the case upon the constitutional complaint of Oleksandr Bredun regarding the constitutionality of Article 87.3.1.2 of the Law of Ukraine “On Public Service” dated December 10, 2015 No. 889-VIII as amended by the Law of Ukraine “On Amending Customs Code of Ukraine and Some Other Legislative Acts of Ukraine in view of the Implementation of Administrative Reform” dated January 14, 2020 No. 440-IX. Issues on constitutional proceedings in this case will be deliberated by the judges at the session of the First Senate.
The First Board of judges of the Second Senate adopted the Ruling (final) on refusing to initiate constitutional proceedings in the case upon the constitutional complaint of Volodymyr Vaniarkha regarding the constitutionality of Article 303 of the Criminal Procedure Code of Ukraine, and adopted the Ruling on initiating constitutional proceedings in the case upon the constitutional petition of the Supreme Court regarding the constitutionality of Article 75.4 of the Family Code of Ukraine. Issues on the constitutional proceedings in this case will be deliberated by the judges at the session of the Grand Chamber.
