Today, on March 15, the First and Second Senates of the Court held sessions to consider the cases upon the constitutional complaints.
The First Senate, in the form of written proceedings at the public parts of the plenary sessions, examined the followings cases:
- upon the constitutional complaint of Oksana Tymoshenkova on the constitutionality of clause 6, a separate provision of the sixth paragraph of clause 19 of Section II "Final and Transitional Provisions" of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecutor's Office" of September 19, 2019 No. 113-IX;
- upon the constitutional complaint of Serhii Vodolahin regarding the constitutionality of clause 2 of Section I of the Law of Ukraine "On Amendments to the Law of Ukraine "On the Status and Social Protection of Citizens Affected by the Chornobyl Disaster" regarding the increase in the level of pensions for certain categories of persons" of June 29, 2021, No. 1584-IX.
The Court has examined the case files in the public parts of the plenary sessions and proceeded to the in-camera parts for decision-making.
The Second Senate at the public parts of the plenary sessions in the form of written proceedings examined the following cases:
- upon the constitutional complaint of Oleksii Abramovych regarding the constitutionality of Article 39.1.2 of the Housing Code of Ukraine;
- upon the constitutional complaints of Mykola Starychenko and Serhii Harlyka on the constitutionality of the third paragraph of clause 3 of Section II "Final and Transitional Provisions" of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecutor's Office" of September 19, 2019 No. 113-IX;
- upon the constitutional complaint of Hanna Pleskach regarding the constitutionality of Article 459.1 of the Code of Criminal Procedure of Ukraine.
In these cases, the Court proceeded to the in-camera parts of the plenary sessions for decision-making.
The Second Senate, in the in-camera part of the plenary session, also continued the consideration of the case upon the constitutional complaint of Ihor Lazurenko regarding the constitutionality of the provisions of Articles 70.2.4 and 70.2.5 of the Law of Ukraine "On Enforcement Proceedings", Artciles 50.2.3 and 50.2.4 of the Law of Ukraine "On Compulsory State Pension Insurance". The Court will continue its consideration at one of the next plenary sessions.
Furthermore, the judges of the Third Banel of Judges of the First Senate considered the issue on initiating constitutional proceedings in the cases upon the constitutional complaint of the Limited Liability Company "TECHNOKHiMREAHENT" regarding the compliance of Article 328.5.2 of the Code of Administrative Procedure of Ukraine with the Constitution of Ukraine and upon the constitutional complaint of Volodymyr Sivolapov regarding the compliance of Articles 294.1.25 and 383.6 of the Code of Administrative Procedure of Ukraine with the Constitution of Ukraine.
Based on the results of examination, the judges issued 2 rulings refusing to initiate the constitutional proceedings in these cases (final).
