On Tuesday, July 20, the Grand Chamber of the Court at the in-camera part of the plenary session proceeded with consideration of the case upon the constitutional petitions of the Supreme Court of Ukraine on the constitutionality of Articles 3.1.6, 3.2.2, 3.2.13, 3.3 of the Law of Ukraine “On Government Cleansing” of September 16, 2014 No. 1682–VII, 47 People's Deputies of Ukraine concerning the compliance of the provisions of Articles 1.3, 1.6, 3.1, 3.2, 3.3. 3.4, 3.8, 5.5.2, paragraph 2 of the Final and Transitional Provisions of this Law with the Constitution of Ukraine, the Supreme Court of Ukraine concerning the compliance of the provisions of Articles 1.3, 3.1.7, 3.1.8, 3.1.9, 3.2.4, paragraph 2 of the Final and Transitional Provisions of this Law with the Constitution of Ukraine and the Supreme Court of Ukraine on compliance of the provisions of Article 4.3 of this Law with the Constitution of Ukraine. The Court will continue its consideration of this case at one of the next plenary sessions.
The session of the Grand Chamber on temporary involvement of a Judge of the Constitutional Court of Ukraine of another Board of the same Senate to the composition of the incompetent Second Board of Judges of the Second Senate of the Constitutional Court of Ukraine to resolve the issue of initiating proceedings in the case upon the constitutional petition of 49 People’s Deputies of Ukraine on the constitutionality of the Decrees of the President of Ukraine “On Removal of the Judge of the Constitutional Court of Ukraine from Office” of December 29, 2020 No. 607/2020, “On Removal of the Judge of the Constitutional Court of Ukraine from Office” of February 26, 2021 No. 79/2021, “On Some Issues of Ensuring the National Security of Ukraine” of March 27, 2021 No. 124/2021 was postponed.
On the same day, the First and Second Boards of Judges of the Second Senate of the Court considered the initiation of constitutional proceedings in the cases upon constitutional complaints of Oleksandr Popov regarding the compliance of Article 12.4 of the Law of Ukraine “On the Status of War Veterans, Guarantees of Their Social Protection” with the Constitution of Ukraine; Ihor Valiulin on the compliance of the provisions of Section 3 of the Law of Ukraine “On Amendments to the Commercial Procedure Code of Ukraine, the Code of Civil Procedure of Ukraine, the Code of Administrative Procedure of Ukraine and other Legislative Acts” of October 3, 2017 No. 2147–VIII with the Constitution of Ukraine; Pavlo Shmatovalenko on the compliance of the provisions of ArticleS 19.6.1, 389.3.2 of the Civil Procedure Code of Ukraine with the Constitution of Ukraine. Based on the results of consideration of the boards of judges, 3 (final) rulings were adopted refusing to initiate constitutional proceedings in these cases.
