22 June. The Court Considered Cases Upon Constitutional Petitions. In the Cases Upon the Constitutional Complaints, the Court Adopted the Rulings

On Thursday, 22 June 2023, at the in-camera part of its plenary session, the Grand Chamber considered cases upon the following constitutional petitions:

 – of the Ukrainian Parliament Commissioner for Human Rights regarding the constitutionality of Article 90, paragraph 2.1 of Section XI „Final and Transitional Provisions“ of the Law of Ukraine „On Civil Service“ of 10 December 2015 No. 889-VIII, Article 21.7 of the Law of Ukraine „On Service in Local Self-Government Bodies“;

– of the Supreme Court regarding the constitutionality of paragraph 11 of Article 34.1, paragraph 10-1 of Section XIII „Final and Transitional Provisions“ of the Law of Ukraine „On Enforcement Proceedings“ of 2 June 2016 No. 1404-VIII, paragraphs 5-1, 5-2 of Section III „Transitional and Final Provisions“ of the Law of Ukraine „On Peculiarities of Establishment of a Joint Stock Company of Public Railway Transport“  of 23 February 2012 No. 4442-VI.

The Court will proceed with deliberation of these cases at one of the next plenary sessions.

The Grand Chamber adopted rulings on the extension until July 20, 2023, the deadline for the adoption by the boards of judges of rulings on initiating or refusing to initiate constitutional proceedings in cases upon constitutional complaints of Anatolii Luzhynetskyi and Yelyzaveta Yevgrafova.

The same day, a session of the Second Board of Judges of the First Senate was held, at which the judges adopted a Ruling (final) on the refusal to initiate constitutional proceedings in the case upon the constitutional complaint of Nataliia Kravchenko regarding the constitutionality of Article 60 of the Civil Procedure Code of Ukraine.
