22 March. The Court Agenda (Approved). The Sessions of the Senates and Boards of Judges Held: 3 Rulings and a Decision Delivered

On Wednesday, March 22, 2023, the Second Senate, at the in-camera part of the plenary session, continued the consideration of the case upon the constitutional complaint of Ihor Lazurenko regarding the compliance of the provisions of Article 70.2.4 and 70.2.5 of the Law of Ukraine "On Enforcement Proceedings", Articles 50.2.3 and 50.2.4 of the Law of Ukraine "On General Compulsory State Pension Insurance" with the Constitution of Ukraine. Based on the results of the consideration, the Court delivered the Decision No. 3-р(ІІ)/2023, which will be published on the Court’s official website on March 23, 2017.

In the in-camera part of the plenary session, the Second Senate continued consideration of the case upon the constitutional complaint of the Representative Office of “Andritz Haidro GmbH” regarding the compliance of the provisions of paragraph 120-1.1 of Article 120-1 of the Tax Code of Ukraine with the Constitution of Ukraine. The case will be considered at one of the next plenary sessions.

In the case uoon the constitutional complaint of Olha Didenko regarding the compliance of the provisions of Article 142.3 of the Law of Ukraine "On the Judiciary and the Status of Judges" dated June 2, 2016 No. 1402-VIII with the Constitution of Ukraine the First Senate adopted the Ruling on termination of the constitutional proceedings in the case.

Also, the First Senate continued consideration of the case upon the constitutional complaint of Oksana Tymoshenkova regarding the compliance of clause 6, and specific provision paragraph six of clause 19 of Section II "Final and Transitional Provisions" of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecution  Bodies" dated September 19, 2019 No. 113-IX (hereinafter – the Law No. 113-IX) with the Constitution of Ukraine.

The First Senate issued a Ruling on termination of the constitutional proceedings in the part regarding the compliance of clause 6 of Section II "Final and Transitional Provisions" of th Law No. 113-IX with the Constitution of Ukraine. The case will be deliberated at one of the next plenary sessions of the First Senate.

On the same day, the Second Board of Judges of the First Senate of the Court issued a ruling on initiating constitutional proceedings in the case upon the constitutional complaint of Van Kolk Frederik Johannes regarding the compliance of Article 481.6.2 of the Customs Code of Ukraine with the Constitution of Ukraine. The case will be deliberated at a session of the First Senate of the Constitutional Court of Ukraine.

Consideration of the issue on initiating constitutional proceedings in the case upon the constitutional complaint of Mykyta Yevstifeiev regarding the constitutionality of Article 389.3.2 of the Code of Civil Procedure of Ukraine was postponed until the next session of the Board.
