Viktor Kryvenko met with a member of the Board of the British Slynn Foundation Sir Robin Auld
On February 7, 2018 Acting Chairman of the Constitutional Court of Ukraine Viktor Kryvenko met with a member of the Board of the British Slynn Foundation Sir Robin Auld.
Judges of the Constitutional Court of Ukraine Viktor Horodovenko and Stanislav Shevchuk, as well as the coordinator of the British Slynn Foundation projects in Ukraine Serhii Vakarin took part in the event.
Sir Robin Auld told the interlocutors that the British Slynn Foundation is following the reforms in Ukraine. He was interested about the amendments to the Constitution of Ukraine in the part of justice: the renewed powers of the Constitutional Court of Ukraine, the procedure for appointing judges of the Constitutional Court of Ukraine and the formation of the Court, the forms of appeal to the Constitutional Court, etc.
Acting Chairman of the Constitutional Court of Ukraine Viktor Kryvenko noted that the Constitutional Court is the only body in Ukraine that has the right to interpret the Constitution and to examine any law on constitutionality. Since the adoption of the relevant decision of the Court, the normative act is invalid, stressed acting Chairman.
Viktor Kryvenko said that the participant of the judicial process (civil, economic or criminal) has the right to lodge a constitutional complaint to the Constitutional Court of Ukraine if he or she considers that the law of Ukraine applied in the final court judgment in his or her case contradicts the Constitution of Ukraine.
Acting Chairman of the Constitutional Court of Ukraine noted that after the Constitutional Court adopts its decision, in which it declares the law, applied in the final court decision unconstitutional, the court of general jurisdiction is obliged to reconsider its decision. However, the Constitutional Court of Ukraine does not adopt prescriptions for its cancellation, he said.
Judge of the Constitutional Court of Ukraine Stanislav Shevchuk stressed that during the constitutional reform in 2016, the official interpretation of the laws of Ukraine was withdrawn from the powers of the Constitutional Court of Ukraine.
Participants of the meeting discussed possible ways of cooperation and thanked each other for constructive dialogue.
