August 3. Agenda of CCU Sessions (Approved). Special Plenary Sessions of the Court, a Plenary Session and a Session of the First Senate and a Session of the Boards of Judges Held

Today, August 3, at special plenary sessions, the Constitutional Court of Ukraine deliberated the changes to the personal composition of the Senate and the personal composition of the Board of Judges of the Constitutional Court of Ukraine. Upon the results, resolutions on the inclusion of judge O.Sovhyria to the composition of the First Senate and the composition of the Second Board of Judges of the respective Senate were adopted.

At the in-camera part of the plenary session, the First Senate deliberated the case upon the constitutional complaint of Roman Unukovych on the constitutionality of a specific provision of Article 204³.1.2 of the Code of Ukraine on Administrative Offenses. Further deliberation of this case will take place at one of the next plenary sessions.

Deliberation of initiation of constitutional proceedings in the case upon the constitutional complaint of Mykola Biliak regarding the conformity of specific provisions of Article 2 of the Law of Ukraine “On Measures for Legislative Support of Pension System Reform” dated July 8, 2011 No. 3668-VI, Article 86.15.6 of the Law of Ukraine “On the Prosecutor's Office” dated October 14, 2014 No. 1697-VII with the Constitution of Ukraine will be proceeded at one of the forthcoming sessions of the First Senate.

On the same day, the First Board of Judges of the First Senate of the Court held a session to deliberate the initiation of constitutional proceedings in cases upon the constitutional complaints.

As a result of the deliberation, two rulings (final) were adopted on the refusal to initiate constitutional proceedings in cases upon the constitutional complaint of Volodymyr Bondarenko regarding the constitutionality of the provisions of Article 87.3.1.2 of the Law of Ukraine “On Civil Service” dated December 10, 2015 No. 889-VIII as amended by Law of Ukraine “On Amendments to the Customs Code of Ukraine and Some Other Legislative Acts of Ukraine in view of the Implementation of Administrative Reform” dated January 14, 2020 No.440-IX and upon the constitutional complaint of Ruslan Onishchenko regarding the constitutionality of the provisions of Article 615.6 of the Criminal Procedure Code of Ukraine as amended by the Law of Ukraine “On Amendments to the Criminal Procedure Code of Ukraine and the Law of Ukraine “On Pretrial Detention” concerning additional regulation of law enforcement activities under martial law” dated March 3, 2022 No. 2111– IX.
