The case upon the constitutional petition of 47 People's Deputies of Ukraine considered by the Court

 

On October 8, the Grand Chamber of the Constitutional Court of Ukraine, at the public part of the plenary session in the form of oral proceedings, considered the case upon the constitutional petition of 47 People’s Deputies of Ukraine on compliance of specific provisions of the laws of Ukraine “On Prevention of Corruption”, “On Prosecutor's Office”, “On National Anti-Corruption Bureau of Ukraine”, “On the State Bureau of Investigation”, “On National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes”, the Criminal Code of Ukraine, the Civil Procedure Code of Ukraine with the Constitution of Ukraine.

The court session was attended by participants in the constitutional proceedings, namely: the representative of the subject of the right to constitutional petition, People’s Deputy of Ukraine Hryhorii Mamka, the Permanent Representative of the Verkhovna Rada of Ukraine in the Constitutional Court of Ukraine Olha Sovhyria and Representative of the President of Ukraine in the Constitutional Court of Ukraine Fedir Venislavskyi, as well as participants in the constitutional proceedings – Rasim Babanly, Head of Analytical and Legal Work Department of the Supreme Court, Roman Hovda, First Deputy Prosecutor General, Andrii Dovhan, Head of the Department of Procedural Management, Support of Public Prosecution and Representation in Court of the Specialized Anti-Corruption Prosecutor's Office, Oleksandr Novikov, Chairman of the National Agency on Corruption Prevention (NACP) of Ukraine, Oleksandr Babikov, First Deputy Director of the State Bureau of Investigation, Ihor Yurchak, Head of the Legal Department of the National Anti-Corruption Bureau of Ukraine, Vitalii Syhydyn, Chairman of the National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes,  Olena Shcherban, Deputy Executive Director of the Anticorruption Action Center,  Mykola Khavroniuk, Representative of the Center for Political and Legal Reforms, Professor of the Department of Criminal and Criminal Procedure Law, Faculty of Law Sciences of the National University “Kyiv-Mohyla Academy”, Doctor of Law, Ihor Bondarchuk, Chairman of the Board  of “Stop Corruption” NGO.

During the plenary session, the motion of the Permanent Representative of the Verkhovna Rada of Ukraine in the Constitutional Court of Ukraine Olha Sovhyria to involve the People's Deputy of Ukraine Anastasiia Radina the participant in the constitutional proceedings was considered and granted.

The Representative of the President of Ukraine in the Constitutional Court of Ukraine Fedir Venislavskyi delivered statements on the recusal of judges of the Constitutional Court of Ukraine Iryna Zavhorodnia, Volodymyr Moisyk, Ihor Slidenko and Oleksandr Tupytskyi from consideration of this case. Following the results of their consideration, the Court refused to recuse judges Iryna Zavhorodna, Volodymyr Moisyk and Ihor Slidenko. The statement on the recusal of judge Oleksandr Tupytskyi was not considered due to his absence.

The Court then adjourned the plenary session to resolve the matter.

The plenary session was chaired by Deputy Chairman of the Constitutional Court of Ukraine Serhiy Holovaty. Ihor Slidenko is a Judge-Rapporteur in the case.
