Vasyl Lemak visited the Yaroslav Mudryi National Law University
On March 16, 2018 the Chairman of the Constitutional Court of Ukraine Stanislav Shevchuk and the judges of the Constitutional Court of Ukraine Viktor Kolisnyk and Vasyl Lemak visited the Yaroslav Mudryi National Law University and held a meeting with professors of the departments of the constitutional law of Ukraine, the theory of state and law, and that of philosophy.
Vice-Rector for Educational Activities Yurii Barabash introduced the guests and congratulated Stanislav Shevchuk on his election as the Chairman of the Constitutional Court of Ukraine. He noted that it was nice to greet him in the alma mater, since Mr. Shevchuk had graduated from the Ukrainian Law Academy (nowadays it is Yaroslav Mudryi National Law University) and completed his graduate studies at this academy; in 1996-1997 he worked as an assistant at the Department of Theory of State and Law.
The Chairman of the Constitutional Court of Ukraine Stanislav Shevchuk noted that it was with the Yaroslav Mudryi National Law University that his life had been connected. "I feel znxious, because it was in this room that the defense of my dissertation took place," added the spokesman.
Stanislav Shevchuk also pointed out that due to the constitutional reform the Constitutional Court of Ukraine had undergone significant transformations, the approach to the formation of the Court, its powers had been changed, which made the Court much more accessible and more open to the citizens. The Chairman of the Constitutional Court of Ukraine stressed that the Court would begin to consider constitutional complaints soon, and that would completely change the face of the modern Ukrainian state. "A person does not care what sign is on a state institution that has to protect his/her rights. The main point is the result. There is still a lot of work ahead, but we are ready for the challenges that will arise in front of us," he said.
In his speech, the judge of the Constitutional Court of Ukraine Vasyl Lemak stressed that the Constitutional Court of Ukraine should always study the cases in a balanced way. "A substantiated judgment of the Court is a key indicator of its authority. A constitutional complaint, in turn, should be seen as a serious challenge for the Court. It is important from the very beginning of their consideration to develop rational legal positions in this aspect," emphasised the judge.
Judge of the Constitutional Court of Ukraine Viktor Kolisnyk emphasised the need to strengthen further the ties between scholars and judges of the Constitutional Court of Ukraine, the importance to continue scientific discussions and consultations, including in connection with the resolution of the constitutional problem arising during the constitutional proceedings in a particular case. He also recalled the Decision of the Court dated December 21, 2017 on the exclusion of candidates for People's Deputies of Ukraine from election party list, which declared the norms which contradicted the principles of democracy; legal certainty and legitimate expectations as an integral part of the rule of law principle; freedom of political activity; free elections and free expression of the will of voters; free deputy mandate, to be unconstitutional.
The presentations of the judges of the Constitutional Court of Ukraine were followed by a large number of important questions, in particular, regarding constitutional justice on the part of professors.
Within the framework of the visit, the Chairman of the Constitutional Court of Ukraine Stanislav Shevchuk participated in the staff meeting of the National Academy of Legal Sciences of Ukraine, during which he delivered a welcoming speech.
In addition, the Chairman of the Constitutional Court of Ukraine met with students of the Criminal Justice and Prosecutors’ Training Institute, during which he dwelt upon the recent decisions of the Constitutional Court of Ukraine. In particular, the decision on the unconstitutionality of Article 315 of the Criminal Procedural Code, according to which the judge cannot extend the term of detention without the prosecutor's request, because this is contrary to the Constitution. The motivation of these decisions is very important and modern, stressed Stanislav Shevchuk.
Chairman of the Constitutional Court of Ukraine Stanislav Shevchuk made an entry in the Book of Honorary Guests at the Yaroslav Mudryi National Law University.
