The Constitutional Court of Ukraine will verify the constitutionality of the legislative provision on determining the amount of the minimum wage, which is used as a calculation value for calculating payments

On 6 September 2024, the Ukrainian Parliament Commissioner for Human Rights submitted a constitutional petition to the Constitutional Court of Ukraine to declare the provision of Article 8.2 of the Law of Ukraine “On the State Budget of Ukraine for 2024” No. 3460-IX  dated 9 November 2023 (hereinafter, “Law”) as inconsistent with the Constitution of Ukraine.

Article 8.2 of the Law provides: “To determine the amount of the minimum wage, which is applied as a calculation value for calculating payments under court decisions, at the level of UAH 1600”.

According to the subject of the right to constitutional petition, this provision does not comply with Articles 8.1, 16, 22.3, 41.4, 50.1, 56, 62.4, 95.2 of the Constitution of Ukraine.

The constitutional petition, in particular, states that the implementation of the provisions of Article 8.2 of the Law has led to a reduction in the amount of the pension supplement that citizens legitimately expected.

The constitutional petition has now been distributed to the judge-rapporteur.
