A constitutional petition of 48 People's Deputies of Ukraine lodged with the Constitutional Court for Consideration

 

On June 15, 2020 the Constitutional Court of Ukraine was seized with a constitutional petition of 48 People's Deputies of Ukraine.

The subject of the right to constitutional petition challenges certain provisions of the Commercial Code of Ukraine, the Law of Ukraine "On Management of State Property Objects", the Procedure for competitive selection of candidates for the position of an independent member of the supervisory board of a state unitary enterprise and their appointment, and those participating in general meeting and elected to the supervisory boards of companies in the authorised capital of which more than 50 percent of shares (stakes) belong to the state, approved by the Resolution of the Cabinet of Ministers of Ukraine of March 10, 2017 № 142, and Requirements for an independent member of the supervisory board of a state unitary enterprise and company, in the authorised capital of which more than 50 percent of shares (stakes) belong to the state, approved by the Resolution of the Cabinet of Ministers of Ukraine of March 10, 2017 № 142.

The subject of the right to constitutional petition considers that the disputed provisions do not comply with a number of articles of the Basic Law of Ukraine.
