Constitutional petition on ensuring guarantees of labour rights of People's Deputies of Ukraine was lodged with the Constitutional Court of Ukraine

On June 13, 2024, the Constitutional Court of Ukraine was lodged  with a constitutional petition of 56 People’s Deputies of Ukraine regarding the constitutionality of the provisions of  Article 20.12 of the Law of Ukraine “On the Status of People's Deputies of Ukraine” No. 2790-XII dated November 17, 1992 and paragraph 14.3 of Section I of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on  Pension Amount Increase” No. 2148-VIII dated October 3, 2017, which relate to ensuring guarantees of labour rights of People's Deputies of Ukraine.

The subject of the right to a constitutional petition, in particular, notes that the legislator, when adopting the disputed legislative provisions, violated the requirement of legitimate expectations as part of the constitutional principle of the rule of law, in particular, deprived of the right to recalculate the pension, which has been already granted.

The People's Deputies believe that the disputed provisions (in terms of extending their effect to the People's Deputies of Ukraine of the I-VII convocations, as well as the People's Deputies of the VIII convocation, whose powers began before October 1, 2017, as well as persons who were entitled to pension provision of the People’s Deputies of Ukraine of the I-VII convocations, as well as the People’s Deputies of Ukraine of the VIII convocation whose terms of office began before October 1, 2017) do not comply with the provisions of Articles 1, 3.2, 8.1,  19.2,  22.3, 41, 46, 64 of the Constitution of Ukraine.

The constitutional petition has been submitted to the judge-rapporteur.
