A Constitutional Petition of the Supreme Court on the Constitutionality of Article 40.1.1. of the Law of Ukraine “On General Compulsory State Social Insurance“ Filed with the Constitutional Court

On March 16, 2023, a constitutional petition of the Supreme Court was filed with the Constitutional Court. The petitioner raises the question of the compliance of Article 40.1.1 of the Law of Ukraine No. 1105-XIV "On General Compulsory State Social Insurance" with the Constitution of Ukraine.

The Supreme Court noted, in particular, that the disputed provision, according to which insurance payments and social services shall be suspended for the entire period of the victim's residence abroad, unless otherwise provided by an international treaty of Ukraine to which mandatory nature the Verkhovna Rada of Ukraine has given its consent, is inconsistent with Article 24.1, 24.2, 25.3, 41.1, 41.4, 46.1 and 64.1 of the Constitution of Ukraine.

Currently, the constitutional petition has been distributed to the judge-rapporteur.
