The Court Adopted 2 Decisions and 7 Rulings

On Wednesday, March 1, the First and Second Senates held hearings where judges considered cases upon constitutional complaints.

During the in-camera part of the plenary session, the First Senate continued to deliberate the case upon the constitutional complaint of Mykola Kostina regarding the constitutionality of a separate provision of paragraph 26 of Section VI "Final and Transitional Provisions" of the Budget Code of Ukraine. The Court will continue its deliberation at one of the forthcoming plenary sessions.

Also, at its session, the First Senate considered the issue of determining the form of constitutional proceedings in the case upon the constitutional complaint of Serhii Vodolahin regarding the constitutionality of paragraph 2 of Section I of the Law of Ukraine "On Amendments to the Law of Ukraine "On the Status and Social Protection of Citizens Affected by the Chornobyl Disaster" regarding the increase in the level of pension provision for certain categories of persons" dated June 29, 2021 No. 1584-IX and issued a Ruling to consider this case in the form of written proceedings.

At the session of the Second Senate, the judges deliberated the issue of determining the form of constitutional proceedings in the cases upon the constitutional complaints of:

- Oleksii Abramovych on the constitutionality of the second paragraph Article 39.2 of the Housing Code of Ukraine;

- Serhiy Harlyka on the constitutionality of the third paragraph of clause 3 of Section II "Final and Transitional Provisions" of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecutor's Office" No. 113-IX dated September 19, 2019;

- LLC “Halytska Trading Company” regarding the constitutionality of the provisions of paragraph 1 of Article 19.6, paragraph 2 of Article 389.3 of the Code of Civil Procedure of Ukraine;

- Artur Boyarov regarding the constitutionality of the first paragraph of Article 380.5 of the Customs Code of Ukraine.

Based on the results of their consideration, rulings were issued to consider the said cases in the form of written proceedings.The Second Senate in the public part of the plenary sessions in the form of written proceedings considered the cases upon constitutional complaints of:

- Ihor Lazurenko on the constitutionality of the provisions of paragraphs four and five of Article 70.2 of the Law of Ukraine "On Enforcement Proceedings", paragraphs three and four of Article 50.2 of the Law of Ukraine "On Compulsory State Pension Insurance";

- Anatolii Dushenkevych regarding the constitutionality of the second paragraph of Article 483.1 of the Customs Code of Ukraine;

- Olha Doroshko and Ivan Kushaba on the constitutionality of paragraphs 1, 5 of Article 19.6, paragraph 2 of Article 389.3 of the Code Civil Procedure of Ukraine;

- Nataliia Trihub regarding the constitutionality of paragraph 2 of Article 44.2 of the Law of Ukraine "On State Market Supervision and Control of Non-Food Products".

Having examined the materials of these cases in the public part of the plenary sessions, the Court proceeded to the in-camera part for decisions.

 

Furthermore, in the in-camera part of the plenary sessions the Second Senate continued consideration of the cases upon constitutional complaints of:

- Serhii Vasylenko on the constitutionality of paragraph 6 of Section II "Final and Transitional Provisions" of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecutor's Office" No. 113-IX dated September 19, 2019;

- Viacheslav Pleskach regarding the constitutionality of the provisions of Articles 294.1 and 383.6 of the Code of Administrative Proceedings of Ukraine.

At the plenary session, the Second Senate adopted two rulings on joining into one case the constitutional proceedings:

- upon the constitutional complaints of Mykola Starychenko on the constitutionality of a separate provision of the third paragraph of clause 3 of of Section II "Final and Transitional Provisions" of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecutor's Office" of September 19, 2019 No. 113-IX and Serhii Harlyka on the constitutionality of clause 3 of Section II "Final and Transitional Provisions" of the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecutor's Office" of September 19, 2019 No. 113-IX;

- upon the constitutional complaints of Anatolii Dushenkevych regarding the constitutionality of the second paragraph of Article 483.1 of the Customs Code of Ukraine and Iryna Yarosh regarding the constitutionality of the provisions of the second paragraph of Article 483.2 of the Customs Code of Ukraine.      

On this day, a special plenary session of the Constitutional Court of Ukraine was also held, at which the judges continued consideration of the appeal of former judge of the Constitutional Court of Ukraine Stanislav Shevchuk. The Court will continue its consideration on March 2.
