The delegation of the Constitutional Court of Ukraine took part in the International Conference in Moldova

 

 

Upon the invitation of the President of the Constitutional Court of the Republic of Moldova Alexandru Tănase on September 8–9, 2014 the Chairman of the Constitutional Court of Ukraine Yurii Baulin and the Judge of the Constitutional Court of Ukraine ViktorShyshkin took part in the International Conference "The Role of Constitutional Justice in Protecting the Values ​of the Rule of Law", held in Moldova's capital Chisinau.

The scientific event preceded by a solemn meeting on the occasion of the 20th anniversary of the Constitution of the Republic of Moldova was attended by leaders of the Moldovan state, heads and judges of the bodies of constitutional jurisdiction of 25 countries, representatives of the judiciary, law enforcement agencies and human rights and scientific institutions of the European Union.

Welcome speeches at the ceremony were presented by the President of the Republic of Moldova Nicolae Timofti, the Speaker of the Parliament of the Republic of Moldova Igor Corman, the Prime Minister of the Republic of Moldova Iurie Leancă, the President of the Constitutional Court of the Republic of Moldova Alexandru Tănase and the President of the Venice Commission of the Council of Europe Gianni Buquicchio.

On behalf of the judges of the Constitutional Court of Ukraine the Chairman of the Constitutional Court Yurii Baulin congratulated the organisers of the forum on the prominent date in the life of their state and stressed the importance and urgency of the issues discussed at the Conference. In his speech he pointed that the idea of the law-governed state had a long history and had a special place in the political doctrines of the past. Following basic principles of a modern law-governed state as the rule of law, its supremacy in all spheres of public life; the reality of human rights and freedoms; mutual responsibility of the state and the individual; separation of powers into legislative, executive and judicial; availability of effective forms of control and supervision over the implementation of laws were formulated on their basis.

The participants discussed a number of reports on such important issues as the search of effective remedies for protection of human rights, ensuring social protection during the financial crisis, implementation of constitutional principles in the society, provision of constitutional identity under globalisation. Judge of the Constitutional Court of Ukraine Viktor Shyshkin prepared report on "The role of individual initiative concerning the interpretation of the laws of Ukraine to ensure the public interest", which will be published in the materials of the Conference together with the texts of other reports.

Within the framework of the Conference Yurii Baulin and Viktor Shyshkin participated in the meeting with the President of the Constitutional Court of the Republic of Moldova AlexandruTănase, held a number of working contacts with their foreign counterparts on co-operation between the bodies of constitutional jurisdiction of Ukraine and European countries. Ukrainian constitutionalists also met with the Ambassador of Ukraine to the Republic of Moldova SerhiiPyrozhkov and discussed the problems of bilateral co-operation between Ukraine and Moldova in the field of international law and the protection of human rights.
