On November 6, 2024, the First Senate, at the public part of the plenary session, initiated the deliberation of the case upon the constitutional complaint of Olena Iliushonok in the form of written proceedings.
During the plenary session, the Judge-Rapporteur in the case, Petro Filiuk, informed that the applicant had appealed to the Court to verify compliance of paragraph 1.17 of Section I of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine on Optimisation of Labour Relations” No. 2352-IX dated July 1, 2022 (hereinafter, the “Law”), which amended Article 119.3 of the Labour Code of Ukraine (hereinafter the “Code”), namely the words “the place of work, position and average earnings are preserved” were replaced by the words “the place of work and position are preserved” with Article 8, Article 17.5, Article 22.3, Article 43.1 of the Constitution of Ukraine.
According to the applicant, the impugned provision of the Law narrows the content and scope of existing rights and freedoms, in particular the right to work, and violates the rule of law principle and the guarantees provided for citizens serving at the Armed Forces of Ukraine.
The Judge-Rapporteur also stated that the Grand Chamber of the Court is deliberating the case upon the constitutional complaints filed by Viktor Soroka, Roman Karpenko, Yurii Prokopenko, Eduard Dudkevych, and Oleksandr Romanenko with the same subject matter of constitutional proceedings.
Olena Iliushonok, the subject of the constitutional complaint, participated in the plenary session and answered a number of clarification questions from the Judges.
The Court has examined the case file and will proceed with deliberation of the case in the in-camera part of the plenary session.
