January 20. The Court Agenda (Approved). The Grand Chamber Deliberated Cases upon Constitutional Petitions and Complaints

Today, January 20, the Grand Chamber of the Constitutional Court of Ukraine in the form of written proceedings proceeded with deliberation of the case upon the constitutional petition of 56 People’s Deputies of Ukraine on the constitutionality of certain provisions of the Law of Ukraine “On Complete General Secondary Education”. The Grand Chamber completed its examination of the case file in the public part and proceeded to the in-camera part of the plenary session.

The Grand Chamber also proceeded with deliberation of the constitutional complaints of A.Zabara, G.Martirosian, S.Trutniev on compliance of Article 142.1 of the Code of Administrative Offenses and N.Kopylova on compliance of Article 14².1, part five of Article 279¹.5 of the Code of Ukraine on Administrative Offenses with the Constitution of Ukraine. The Court will deliberate this case at the forthcoming plenary session.

At the session, the judges of the Grand Chamber deliberated the issue of determining the form of constitutional proceedings in the case upon the constitutional petition of 49 People’s Deputies of Ukraine on compliance with the Constitution of Ukraine of the decrees of the President of Ukraine “On removal of the judge of the Constitutional Court of Ukraine from office” of December 29, 2020 No. 607/2020,  “On removal of the judge of the Constitutional Court of Ukraine from office” of February 26, 2021 No. 79/2021”, “On Some Issues of Ensuring the National Security of Ukraine” dated March 27, 2021 No. 124/2021. Upon the results, the Grand Chamber of the Court ruled to deliberate the respective case in the form of oral proceedings.

A session of the Third Board of Judges of the First Senate of the Court on initiating constitutional proceedings was held.

In particular, in the case upon the constitutional complaint of M.Borodkin regarding the compliance of the provision of Article 9.1.2 of the Law of Ukraine “On the State Bureau of Investigation” with the Constitution of Ukraine a Ruling on initiating constitutional proceedings was issued.

In the case upon the constitutional complaint of L.Dychkovskyi regarding the compliance of the provisions of Article 5.1.13 of the Law of Ukraine “On Judicial Fees” with the Constitution of Ukraine a Ruling on refusal to initiate constitutional proceedings (final) was issued.
