Judge of the Constitutional Court of Ukraine Mykhailo Hultai participated in the international conference of constitutionalists in the Principality of Andorra
Judge of the Constitutional Court of Ukraine Mykhailo Hultai participated in the International Conference "The Constitutional Courts: A Warranty of the Democratic Qualities of Societies?" held on July 12-13, 2018 on the occasion of the 25th anniversary of the Constitutional Court of the Principality of Andorra.
Representatives of the authorities of the Principality of Andorra, delegations of the bodies of constitutional jurisdiction of more than 40 countries, in particular Albania, Belgium, Cape Verde, Congo, Croatia, Cyprus, Egypt, Guinea-Bissau, Hungary, Kazakhstan, Kosovo, Latvia, Libya, Lithuania, Luxembourg, Moldova, Montenegro, Serbia, Slovenia, Switzerland as well as the members of the European Commission for Democracy through Law (Venice Commission) took part in the academic forum.
During the conference, the participants had lively discussions on ensuring the supremacy of the Constitution in the legal system of the state, protection by the bodies of constitutional jurisdiction of fundamental rights enshrined in the Constitutions and international legal texts, guarantees of ensuring the separation of powers between the central and local authorities. Particular attention was paid to critiques of the case law of constitutional courts on the part of state authorities, the mass media and the public.
In addition, during the event the issues of strengthening the independence of the bodies of constitutional jurisdiction, ensuring the impartiality of their decisions, as well as organisation of work of the constitutional courts of the participating countries, guarantees of independence of judges, their powers and responsibility were debated. The participants of the conference also focused on the institute of dissenting opinion in the constitutional court proceedings.
Upon the results of the international conference a collection of materials including reports and presentations of its participants will be published.
According to the program, the participants of the conference visited the Parliament of the Principality of Andorra, as well as on the National Day of the French Republic - the Bastille Day - the Embassy of the French Republic in the Principality of Andorra.
During the visit the judge of the Constitutional Court of Ukraine Mykhailo Hultai held working meetings with the leadership of the Constitutional Court of the Principality of Andorra, representatives of constitutional jurisdictions of the participating states, the Venice Commission, and met with Honorary Consul of Ukraine to Principality of Andorra Mr. Antonio Zorzano Riera.
During the meetings, the importance of exchanging experience in the field of the protection of human rights and freedoms by the bodies of constitutional control was especially emphasised.
