The Summer School “Constitutionalism and the Rule of Law in Extreme Conditions: Government, Society and Democracy”, which took place on 7–12 August, has come to an end. The event is organised annually for 30 students of Ukrainian higher education institutions and is aimed at in-depth discussion of topical issues of constitutional law.
Each day, experts in the field of constitutional and European law, theory and philosophy of law, representatives of public authorities, leading domestic and foreign scholars, legal practitioners and representatives of civil society delivered their presentations.
The Constitutional Court of Ukraine was represented by judges of the Constitutional Court of Ukraine Oksana Hryshchuk, Vasyl Lemak and Oleksandr Petryshyn.
The judges of the Constitutional Court of Ukraine focused their presentations on important and topical issues of constitutional justice, particularly the challenges faced by the body of constitutional jurisdiction of Ukraine and the peculiarities of its work in the conditions of war.
Oleksandr Petryshyn, a judge of the Constitutional Court of Ukraine, presented the following presentations “Official Interpretation of Constitutional Provisions: Traditions and Innovations” and “The Principle of a Democratic State: Approaches to Interpretation in the Practice of the Constitutional Court of Ukraine”.
Oksana Hryshchuk, a judge of the Constitutional Court of Ukraine, told the participants about European legal values in the legal positions of the Constitutional Court of Ukraine.
Vasyl Lemak, a judge of the Constitutional Court of Ukraine, addressed the issue of reasoning in the decisions of the Constitutional Court of Ukraine and its development. The judge also revealed the peculiarities of constitutional proceedings in Ukraine during wartime.
The Summer School participants discussed a number of topical issues related to the protection of human rights and freedoms during the war, the interpretation of constitutional values in extreme conditions, and discussed the methodology of interpreting normative acts in the process of assessing their constitutionality. In addition, the lecturers focused on the peculiarities of applying the Constitution in the administration of justice, the implementation of ECtHR judgments, as well as the interpretation of the Constitution in the light of European legal values.
The event was traditionally organised by the OSCE in cooperation with the Constitutional Court of Ukraine.
