Today, July 13, the First and Second Senates of the Constitutional Court of Ukraine deliberated the following cases at the public part of plenary sessions in the form of written proceedings:
- upon the constitutional complaint of Mykhailo Tsymbal regarding the compliance of the provisions of Article 361.5.1 of the Code of Administrative Procedure of Ukraine with the Constitution of Ukraine;
- upon the constitutional complaint of Vitalii Kovbasiuk regarding the compliance of specific provisions of Article 2 of the Law of Ukraine “On Measures for Legislative Support of Reforming the Pension System” dated July 8, 2011 No. 3668-VI, Article 86.15.6.1 of the Law of Ukraine “On the Prosecutor's Office” dated October 14, 2014 No. 1697-VII with the Constitution of Ukraine;
- upon the constitutional complaint of Mykhailo Borodkin regarding the compliance of the provisions of Article 9.1.2 of the Law of Ukraine “On the State Bureau of Investigations” dated November 12, 2015 No. 794-VIII as amended with the Constitution of Ukraine;
- upon the constitutional complaint of Viacheslav Pleskach regarding the compliance of the provisions of Articles 294.1 and 383.6 of the Code of Administrative Procedure of Ukraine with the Constitution of Ukraine;
- upon the constitutional complaint of Viktor Petrenko regarding the compliance of Article 2 of the Law of Ukraine “On Measures for Legislative Support of Reforming the Pension System” dated July 8, 2011 No. 3668-VI with the Constitution of Ukraine.
The First and Second Senates of the Court completed the study of case files at the public part of the plenary sessions and proceeded to the in-camera part. Deliberation of the cases will be continued at one of the forthcoming plenary sessions of the First and Second Senates of the Court, respectively.
At the in-camera part of the plenary session, the Second Senate deliberated the case upon the constitutional complaint of Volodymyr Zhydenko regarding the compliance of specific provisions of Article 2 of the Law of Ukraine “On Measures for Legislative Support of Reforming the Pension System” with the Constitution of Ukraine.
Deliberation of the case will be proceeded at one of the next plenary sessions of the Second Senate.
In addition, the Second Senate adopted a Ruling on merging constitutional proceedings in the case upon the constitutional complaint of Volodymyr Zhydenko regarding the compliance of specific provisions of Article 2 of the Law of Ukraine “On Measures for Legislative Support of Reforming the Pension System” with the Constitution of Ukraine and in the case upon the constitutional complaint of Viktor Petrenko regarding the compliance of Article 2 of the Law of Ukraine “On Measures for Legislative Support of Reforming the Pension System” dated July 8, 2011 No. 3668-VI with the Constitution of Ukraine.
On the same day, a session of the Third Board of Judges of the First Senate of the Court was held to deliberate the issue of initiating constitutional proceedings in the case upon the constitutional complaint of the Limited Liability Company “Halytska Trade Company” regarding compliance of the provisions of Articles 19.6.1, 389.3.2 and 394.2.1 of the Code of Civil Procedure of Ukraine with the Constitution of Ukraine.
Upon the results of the deliberation, the Ruling (final) of the Board of Judges on the refusal to initiate constitutional proceedings in the case was adopted.
