Meeting of the Acting Chairman of the Constitutional Court of Ukraine Yurii Baulin with judges of the European Court of Human Rights

 

On March 24, 2017 Acting Chairman of the Constitutional Court of Ukraine Yurii Baulin met the judges of the European Court of Human Rights in respect of Ukraine Ganna Yudkivska and Liechtenstein Carlo Ranzoni.

The meeting was also attended by the judges of the Constitutional Court of Ukraine Mykhailo Hultai, Volodymyr Moisyk and Serhii Vdovichenko.

Yurii Baulin informed the guests about the International Conference on “Constitutional Control and the Processes of Democratic Transformation in Modern Society” dedicated to the 20th anniversary of the Constitutional Court of Ukraine which was held last year, and presented a copy of conference materials.

The interlocutors discussed interrelation of the national constitution and the case-law of the European Court of Human Rights, particularly on the protection of social rights.

Acting Chairman of the Constitutional Court of Ukraine said that the Constitutional Court of Ukraine is a member of the Association of Constitutional Justice of the Countries of the Baltic and Black Sea Regions, which was founded in October 2015 in Vilnius. The presidency of the Association is carried out on rotation and it is held by each member of the Association for a one-year term. From January 1, 2017 the Presidency of the Association passed to Ukraine.

The Constitutional Court of Ukraine will hold the Second Congress of the Association on „The role of constitutional courts in the developing of the provisions of national constitutions in the context of the generally recognised principles and norms of international law and EU law, decisions of international courts“ on May 31 – June 4, 2017 in Kharkiv, said Yurii Baulin and invited the guests to attend.

Every ECHR’s judgment is the interpretation of the Convention, and it shall not limit the right of national courts, noted judge of the European Court of Human Rights in respect of Ukraine Ganna Yudkivska.

The Constitutional Court of Ukraine expects the adoption of the Law of Ukraine "On Constitutional Court of Ukraine" and is getting prepared for dealing with constitutional complaints, reported Yurii Baulin. "We hope that the introduction of the constitutional complaint in Ukraine will reduce the workload of the European Court of Human Rights", said Acting Chairman.

At the end of the meeting, the parties thanked each other for the constructive meeting and expressed hope for further fruitful cooperation.

The visitors also had a tour around the Court, including the courtroom, press center, museum exhibition of the Constitutional Court of Ukraine.
