October 4. Agenda of Court’s Sessions (Approved). The Court Postponed the Deliberation of the Case upon the Constitutional Petition of 48 People's Deputies of Ukraine. The Board of Judges Adopted 7 Rulings

Today, October 4, the Grand Chamber postponed the deliberation of the case upon the constitutional petition of 48 People's Deputies of Ukraine regarding the conformity with the Constitution of Ukraine of specific provisions of the Economic Code of Ukraine, the Law of Ukraine “On the Management of State-Owned Objects”, the Procedure for identifying and approving candidates of state representatives appointed to supervisory boards of state unitary enterprises, and those who participate in general meetings and are elected to supervisory boards of economic companies, in the authorised capital of which more than 50 percent of the shares (parts) belong to the state, approved by the Resolution of the Cabinet of Ministers of Ukraine dated March 10, 2017 No. 143, and Requirements for an independent member of the supervisory board of a state unitary enterprise and economic companies, in the authorised capital of which more than 50 percent of shares (parts) belong to the state, approved by Resolution No. 142 of the Cabinet of Ministers of Ukraine dated March 10, 2017. Deliberation of this case in the public part of the plenary session in the form of written proceedings will take place at one of the forthcoming plenary sessions.

On the same day, a session of the Third Board of Judges of the Second Senate was held, at which 6 rulings (final) were adopted on the refusal to initiate constitutional proceedings in cases upon constitutional complaints:

- Iryna Rizdvanetska regarding compliance of Article 191.2 of the Family Code of Ukraine with the Constitution of Ukraine;

- Yurii Deineko regarding the compliance of Articles 68.1 and 68.2 of the Law of Ukraine “On the Judiciary and the Status of Judges” dated June 2, 2016 No. 1402–VIII with the Constitution of Ukraine;

- Hennadii Bilobrov regarding compliance of Article 23.2 of the Law of Ukraine “On Mortgages” with the Constitution of Ukraine;

- Dmytro Lysytskyi regarding compliance of Article 23.2 of the Law of Ukraine “On Mortgages” with the Constitution of Ukraine;

- Artem Deryhlazov regarding the compliance of subparagraph 36, clause “c” of subparagraph 48 of paragraph 7 § 1, paragraph 1 § 3 of Section 4 of the Law of Ukraine “On Amending the Economic Procedure Code of Ukraine, the Civil Procedure Code of Ukraine, the Code of Administrative Procedure of Ukraine and Other Legislative Acts” dated October 3, 2017 No. 2147-VIII with the Constitution of Ukraine;

- Yurii Haltsov regarding compliance of Article 82.1 of the Criminal Code of Ukraine with the Constitution of Ukraine.

In the case upon the constitutional complaint of Olena Serbina regarding the conformity with the Constitution of Ukraine of Article 2 of the Law of Ukraine “On Measures for Legislative Support of Pension System Reform”" dated July 8, 2011 No. 3668-VI, Article 86.15.6.1 of the Law of Ukraine “On Prosecutor's Office” dated October 14, 2021 No. 1697-VII the Third Board of Judges of the Second Senate adopted the Ruling on initiating constitutional proceedings.
