Representatives of the Constitutional Court of Ukraine took part in the discussion on issues of restriction of human rights and freedoms in health emergencies
On September 7-8, employees of the Constitutional Court of Ukraine took part in the VIII Summer School organised by the Constitutional Court of the Republic of Turkey. This year's theme of the school is: "Restriction of Human Rights and Freedoms in Health Emergencies: The Example of COVID-19".
The list participants included representatives of the constitutional jurisdiction bodies of Albania, Algeria, Azerbaijan, Georgia, India, Indonesia, Kazakhstan, Macedonia, Malaysia, South Korea, Thailand, Uzbekistan and other countries.
On behalf of the Constitutional Court of Ukraine, Oleksandra Spinchevska, Deputy Head of the Preliminary Opinions Division of the Constitutional Petitions and Constitutional Appeals Processing Department of the Legal Directorate, and Olha Shmyhova, Chief Consultant of the Comparative Research Division of the Comparative Legal Analysis Department of the Legal Directorate took part in the online event.
The Summer School began with an opening ceremony, during which the President of the Constitutional Court of the Republic of Turkey Prof. Dr. Zühtü Arslan addressed the participants with a welcoming speech.
During the event, there were lively discussions on the constitutional and legal framework for health emergencies and COVID-19 measures.
The practical application of the above mentioned issues in the fight against coronavirus infection is especially relevant. The participants of the school raised the issue of imposing a state of emergency due to COVID-19, the application of local and national measures, their compatibility with fundamental human rights. Particular attention was paid to the issue of appealing to the courts against emergency measures in the field of health care, as well as the results of their court proceedings.
The interlocutors also exchanged information on the peculiarities of the constitutional regulation of national emergencies in the field of health care, their differences from other emergencies and the possibility of their judicial review.
Representatives of the Constitutional Court of Ukraine joined the discussion of the above issues, emphasising that they are united by the relevance and universality of the problems that have arisen in different countries, and at the same time they are close to many of us in today's conditions.
