On July 11-12, 2024, the Judges of the Constitutional Court of Ukraine, representatives of the German Foundation for International Legal Cooperation (IRZ), and former judges of the Federal Constitutional Court of Germany held an online talks as part of an expert exchange of experience in constitutional law and constitutional procedure law.
The event was organised by the German Foundation for International Legal Cooperation (IRZ), a long-standing partner of the Constitutional Court of Ukraine, which regularly organises Ukrainian-German expert talks on constitutional law and facilitates fruitful exchange of experience at the level of constitutional jurisdictions of the two countries.
The talks brought together judges of the Constitutional Court of Ukraine Viktor Gorodovenko, Oksana Hryshchuk, Vasyl Lemak, Oleh Pervomaiskyi, Oleksandr Petryshyn, Galyna Yurovska, Senior Project Manager of the IRZ Foundation Wolfram Hertig, former Judges of the Federal Constitutional Court of Germany Reinhard Gaier and Udo Steiner, as well as Head of the CCU Secretariat Viktor Beschastnyi and First Deputy Head of the Court Secretariat Larysa Biriuk.
The main topics of discussion were:
recusal (self-recusal) of a constitutional court judge due to a conflict of interest;
the “res iudicata” principle and possible exceptions to its application in the jurisprudence of the constitutional court;
abuse of the right to appeal to the constitutional court;
protection of personal data in the jurisprudence of the constitutional court.
The Judges of the Constitutional Court of Ukraine together with their German colleagues discussed the problems they face when dealing with procedural issues of constitutional justice. The IRZ Foundation experts shared their own experience on the respective issues, referring to the jurisprudence of the Federal Constitutional Court of Germany, and answered the questions of the Ukrainian Judges.
