The Constitutional Court of Ukraine learns from Latvian experience of the functioning
of the institute of constitutional complaint

 

The Constitutional Court of Ukraine has started a series of lectures and discussions in the form of webinars, which are held within the project "Reinforcing the Capacity of the Legal Service of the Constitutional Court of Ukraine" and will last until October 16, 2020. This event is supported by the Ministry of Foreign Affairs of the Republic of Latvia.

 Practical experience is shared by the head of this project Alla Spale, the head of the Legal Department of the Constitutional Court of the Republic of Latvia Kristaps Tamužs and the advisor of the Court Elina Podzorova.

 The Head of the Secretariat of the Constitutional Court of Ukraine Viktor Beschastnyi thanked the representatives of the Constitutional Court of the Republic of Latvia for the possibility of joint implementation of the project. He expressed hope that such an exchange of experience would allow to get acquainted with theoretical issues concerning the functioning of the constitutional complaint institute, as well as with practical aspects that the Constitutional Court of the Republic of Latvia had to face both at the initial stage of implementation of the complaint in the legal system of Latvia, and at later stages of work with it. As Viktor Beschastnyi mentioned, the experience gained by the staff of the Secretariat of the Constitutional Court of Ukraine will be useful in its daily activities.

During the first webinar, which took place on October 5, representatives of the Secretariat of the Constitutional Court of Ukraine got acquainted with the organization of work of the body of constitutional jurisdiction of Latvia and its structure, as well as the main directions of communication strategy of the Constitutional Court of Latvia.

 The program of the following webinars includes a discussion of a number of issues concerning the model of the Latvian constitutional complaint, its admissibility criteria, the procedure for preparing cases on constitutional complaints, the legal consequences of Court decisions, their reasoning, and the mechanism of execution of Court decisions.
