November 9. The Sessions of the Second Senate and the Board of Judges Held: 4 Rulings Adopted

On Wednesday, November 9, the Second Senate, at the in-camera part of the plenary session, proceeded with the deliberation of the case upon the constitutional complaints of Liudmyla Solomakha and Valerii Burbak regarding the conformity of the provisions of Article 142.3 of the Law of Ukraine “On the Judiciary and the Status of Judges” of June 2, 2016 No. 1402-VIII with the Constitution of Ukraine. The deliberation of the case will be continued at one of the next plenary sessions.

At its plenary session, the Second Senate adopted the Ruling on merging cases upon two constitutional complaints of Serhii Syrotenko regarding the conformity of certain provisions of Articles 171.9.2 and 246.5.4 of the Code of Administrative Procedure of Ukraine with the Constitution of Ukraine.

In addition, at its session, the Second Senate adopted the Ruling on the deliberation of the case upon the constitutional complaint of Serhii Syrotenko in the form of written proceedings.

In the case upon the constitutional complaint of Volodymyr Chaikin regarding the conformity of Article 394.2.1 of the Code of Civil Procedure of Ukraine with the Constitution of Ukraine, the Second Senate adopted a Ruling (final) on the refusal to initiate certain constitutional proceedings.

On the same day, a session of the Second Board of Judges of the Second Senate was held. At this session, the Ruling on initiating constitutional proceedings in the case upon the constitutional complaint of Ruslan Onishchenko regarding the conformity of Article 615.6 of the Code of Criminal Procedure of Ukraine with the Constitution of Ukraine was adopted. Issues related to the constitutional proceedings in the case will be deliberated at the session of the Second Senate.
