September 22. The Court Agenda (Approved). The Second Senate of the Court and the Board of Judges Considered a Number of Issues

Today, September 22, the Second Senate and the Board of Judges held their sessions.

The Second Senate considered the issue of initiating constitutional proceedings in the case upon the constitutional complaint of a citizen of Ukraine Ihor Hubko on the constitutionality of the provisions of Article 361.5.1 of the Code of Administrative Procedure of Ukraine. The Court will proceed with consideration of this issue at one of the further sessions.

Based on the results of consideration of the issue of initiating constitutional proceedings in the case upon the constitutional complaint of Oleksandr Krotiuk on constitutionality of the provisions of Article 284.1.4 of the Criminal Procedure Code of Ukraine, the Second Senate of the Constitutional Court of Ukraine ruled to initiate constitutional proceedings in the case.

The Second Senate also considered the issue of determining the form of constitutional proceedings in the case upon the constitutional complaint of Volodymyr Soloviov on the constitutionality of certain provisions of Section 3 of the Law of Ukraine "On Amendments to the Commercial Procedural Code of Ukraine, the Civil Procedure Code of Ukraine, the Code of Administrative Procedure of Ukraine and other Legislative Acts" of October 3, 2017 No. 2147-VIII. The Ruling of the Second Senate on consideration of the case in the form of written proceedings was adopted.

In addition, today, the First Board of Judges of the Second Senate held a session to consider the issue of initiating constitutional proceedings in the case upon Ivan Kushaba's constitutional complaint on the constitutionality of Article 424 of the Code of Criminal Procedure of Ukraine. Based on the results of the consideration, the Ruling (final) of the Board of Judges on the refusal to initiate constitutional proceedings in this case was adopted.
