September 6. Sessions of the Grand Chamber Held: Cases upon the Constitutional Petitions Deliberated. The Court Adopted 56 Rulings

On Tuesday, September 6, the Grand Chamber proceeded with deliberation of the cases at the in-camera part of the plenary session:

-  upon the constitutional petition of 50 People's Deputies of Ukraine regarding the conformity of the Law of Ukraine “On Amendments to Article 80 of the Constitution of Ukraine (On the Immunity of People's Deputies of Ukraine)” with the Constitution of Ukraine;

- upon the constitutional petition of 45 People's Deputies of Ukraine regarding the compliance of Articles 133-191, subparagraph 2 of paragraph 2 of Section XXXXII “Final and Transitional Provisions|” of the Election Code of Ukraine with the Constitution of Ukraine.

Their deliberation will be proceeded at one of the next plenary sessions.

In addition, the Grand Chamber at the session adopted 54 rulings on extending until October 6, 2022 the deadline for the adoption by the boards of judges of the Court of rulings on initiating or refusing to initiate constitutional proceedings in cases upon constitutional petitions of the Supreme Court, 99 People's Deputies of Ukraine, a constitutional appeal of the Verkhovna Rada of Ukraine and constitutional complaints.

On the same day, a session of the First Board of Judges of the Second Senate took place, at which the issue of initiating constitutional proceedings in cases upon  citizens' constitutional complaints was deliberated.

Upon the results of the deliberation, the Ruling of the board of judges (not unanimous) was adopted on refusal to initiate constitutional proceedings in the case upon the constitutional complaint of Viktoriia Kalyta regarding the conformity of the provisions of clauses 9, 10 of subparagraph 41 of paragraph 21 of  Section I, paragraph 6, clause 6 of paragraph 19 of Chapter II “Final and Transitional Provisions” of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine Regarding Priority Measures for the Reform of Prosecutor's Offices” dated September 19, 2019 No. 113-IX with the Constitution of Ukraine. The issue of initiating constitutional proceedings in this case will be deliberating at a session of the Second Senate .

In the case upon the constitutional complaint of Mykyta Yevstifeiev regarding the conformity of the provisions of Article 328.2 of the Code of Administrative Procedure of Ukraine with the Constitution of Ukraine, the Ruling of the board of judges (final) on refusal to initiate constitutional proceedings was adopted.
