September 7. The First and Second Senates Deliberated the Cases upon Constitutional Complaints

On Wednesday, September 7, at a session the First Senate deliberated the issue of initiating constitutional proceedings in the case upon the constitutional complaint of Mykola Biliak regarding the conformity of certain provisions of Article 2 of the Law of Ukraine “On Measures for Legislative Support of Pension System Reform” dated July 8, 2011 No. 3668-VI, Article 8.15.6 of the Law of Ukraine “On the Prosecutor's Office” dated October 14, 2014 No. 1697-VII with the Constitution of Ukraine. The Ruling on initiating constitutional proceedings in the case was adopted.

In addition, the First Senate adopted the Ruling on the deliberation of the case upon the constitutional complaint of M.Biliak in the form of written proceedings.

The Second Senate also held plenary sessions. The case was deliberated upon the constitutional complaint of the Representative Office of “ANDRITZ HYDRO GmbH” regarding the constitutionality of the provisions of paragraph 120-1.1 of Article 120-1 of the Tax Code of Ukraine. Its further deliberation will take place at one of the forthcoming plenary sessions.

The Second Senate adopted the Ruling on terminating the constitutional proceedings in the case upon the constitutional complaint of Volodymyr Soloviov regarding the conformity of certain provisions of Section 3 of the Law of Ukraine “On Amendments to the Economic Procedure Code of Ukraine, the Civil Procedure Code of Ukraine, the Code of Administrative Procedure of Ukraine and Other Legislative Acts” dated October 3, 2017 No. 2147-VIII with the Constitution of Ukraine.

On the same day, a session of the First Board of Judges of the First Senate was held, at which the Ruling (final) was adopted on the refusal to initiate constitutional proceedings in the case upon the constitutional complaint of Tetiana Popova regarding the conformity of  Article 51.2 of the Law of Ukraine “On Local Self-Government in Ukraine” with the Constitution of Ukraine.
