Sessions of the First and Second Senates and the Board of Judges Were Held

 

On Wednesday, June 2, the First Senate of the Constitutional Court of Ukraine considered the issue of determining the form of constitutional proceedings in the case upon the constitutional complaint of Mykola Kostina on the constitutionality of a separate provision of paragraph 26 of Section VI "Final and Transitional Provisions" of the Budget Code of Ukraine. Based on the results of the session, the Ruling on consideration of the case in the form of written proceedings was adopted.

On the same day, a plenary session of the Second Senate was held in order to consider cases upon constitutional complaints of Anatolii Kremenchutskyi and Vladyslav Pavlyk regarding the compliance of the provisions of Article 294.10 of the Code of Ukraine on Administrative Offences with the Constitution of Ukraine, as well as upon the constitutional complaint of Oleksii Abramovych on the constitutionality of the provisions of paragraph 2 of Article 40.2 of the Housing Code of the Ukrainian SSR. The Court will proceed with consideration of these cases.

In addition, a session of the Second Board of Judges of the Second Senate was held to consider the issue of initiating constitutional proceedings in the case upon the constitutional petition of 49 People's Deputies of Ukraine on the compliance of the Presidential decrees “On Removal from Office of a Judge of the Constitutional Court of Ukraine” of December 29, 2020 № 607/2020, “On Removal from Office of a Judge of the Constitutional Court of Ukraine” of February 26, 2021 № 79/2021, “On Some Issues of Ensuring the National Security of Ukraine” of March 27, 2021 № 124/2021 with the Constitution of Ukraine. The issue will be considered at one of the further sessions of the Board.

The Second Board of Judges of the Second Senate also considered the issue of initiating constitutional proceedings in the case upon the constitutional complaint of citizen Ihor Gubko on the constitutionality of the provision of paragraph 1 of Article 361.5 of the Code of Administrative Procedure of Ukraine. Following the consideration of this issue, the Ruling of the Board of Judges on the refusal to initiate constitutional proceedings was adopted. The constitutional complaint of Ihor Gubko is submitted to the Second Senate for a decision on the initiating constitutional proceedings in the case.

Upon the constitutional complaint of Kostiantyn Koshyk on the compliance of certain provisions of Article 130.1 of the Code of Ukraine on Administrative Offenses with the Constitution of Ukraine, the Second Board of Judges of the Second Senate adopted a ruling (final) on refusal to initiate constitutional proceedings in the case.
